TERMS OF USE for Ann Marie Hershberger Art and Design

1.  All artwork and content produced by Ann Marie Hershberger to include originals, prints, digital files, videos and blogs are copywrited and belong solely to the creator, Ann Marie Hershberger.  After sale the images associated with original art, video and blog content remain in Ann Marie Hershberger Art and Design ownership with the explicit purpose of utilizing images in future posts or future content creation and portfolio pages.  If artwork, images, video and blog content is shared through social media, such as Instagram, Pinterest, Facebook, Etsy and personal blogs credit must be given to Ann Marie Hershberger Art and Design.  Original art and reproductions, video and blog content are not to be used for professional use (profit) or reproduction unless explicitly contracted with Ann Marie Hershberger. The artwork and content is for personal or personal education use only.  Contracted work, such as commissions and licensing, will be governed by the terms outlined in a specific contract to be signed by both parties prior to the commencement of said specific project.  
 
2.   Purchases are completed through the website or Etsy shops and conducted through Paypal, Wix and Etsy payment options and under the jurisdiction of those payment companies Terms of Use.  Refunds are obtained through contact with Ann Marie Hershberger Art and Design if not completely happy with purchase on any of her sites to include her website, Ann Marie Hershberger Art and Design, Instagram and Etsy.  Original art and reproductions of art to include prints and associated products must be returned without damage in secure shipping to prevent damage while enroute.  Refunds will be issued within 8-10 days of return of product minus the cost of shipping fees associated with the return of the product.  Products must be returned in shipping containers able to protect original and reproduction artwork enroute from water damage and wear and tear.
 
3.  Digital downloads are not included in this refund policy.  All purchases of immediate, downloadable digital art and design and associated files are not refundable.  Video and associated blog content is not included in this refund policy.  All purchases associated with video or blog content is non refundable.  
 
4.  Art may be photographed in a frame for aesthetic presentation on sale pages but unless the description details the inclusion of a frame it must be assumed that the original artwork or print price does not include a frame.  Any artwork that does include the frame is reflected in the price and noted in the product description clearly on website, Etsy and Instagram posts.  That said, Ann Marie is available for consultation if questions arise or advice is sought regarding the framing of a purchased piece of art or reproduction.
 
5.  All promotions and sales will be clearly documented at the point of sale with a clear beginning and end date.  Sale of product that occurs outside of these dates will be conducted at the normal rate.  
 
6.  Regarding blog and video comments and interactions:  All comments will maintain certain boundaries of decency and politeness.  Ann Marie maintains the right to revoke anyone’s privilege of commentary immediately, definitively and permanently if boundaries of decency and politeness are not respected.  Inappropriate comments include but are not limited to harassment and racist, discriminatory and derogatory language.  
 
7.  Terms of use regarding privacy policy and use of cookies is covered in the Policy document located on Ann Marie Hershberger Art and Design website, http://www.annmariehershberger.com.  
 
8.  Updates to terms and conditions will occur from time to time without general notification so it is incumbent upon the website user/visitor/customer to check back to both the Policy and Terms and Conditions documents.
